State of mind for FMLA Notice?

With increasing numbers of people with taking care of older parents or having other family obligations, it’s becoming more and more important for Employers to be especially cognizant of the reason for extended or repeated lateness or absenteeism.

 

Employers must beware of all circumstances in which employees don’t report for work. It is the responsibility of Company Management, preferably under the advice of legal counsel, to assess whether any absence qualifies the worker for FMLA protection and act accordingly. Failure to do so can result in heavy and costly litigation as well as awards of back pay and liquidated damages.
